Terms of Service

Welcome to Thalweg Fishing. These Terms of Service ("Terms") govern your use of Thalweg Fishing and this website (the "Service"), operated by Thalweg Fishing LLC ("we," "our," or "us").

These Terms apply whenever access to the Service is provided.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

2. Account registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and update your information as necessary
Keep your sign-in credentials and devices secure
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activity under your account

Email and password, Apple, and Google sign-in are supported. If you use an outside sign-in provider, its account terms also apply.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Subscriptions

Full, the Service’s paid plan, is an auto-renewing subscription sold through the App Store or Google Play, or by us on the web with Stripe as our payment processor. The price and billing period are shown before you buy, and the store or payment processor charges you.

A subscription renews automatically at the end of each period until you cancel it. Cancellation takes effect at the end of the period you have already paid for. If you bought through the App Store or Google Play, you cancel in that store, and its rules decide refunds. If you bought on the web, you cancel from Manage on your Profile, and refund requests come to us through support.

A free trial, a complimentary period we grant, or a redeemed code gives you Full without charge for its stated period. It is not transferable.

We will announce a price change before it applies. Where a store’s rules require it, the store asks for your consent before the new price applies to you.

Deleting your account ends a web subscription. It does not cancel an App Store or Google Play subscription; cancel that in the store where you bought it.

4. Acceptable use

You agree to use the Service only for lawful purposes. You will not:

Violate any applicable laws, regulations, or third-party rights
Use the Service for any illegal fishing activities or to facilitate violation of fishing regulations
Attempt to gain unauthorized access to the Service, other accounts, or connected systems
Interfere with or disrupt the Service or servers connected to the Service
Use automated scripts, bots, or other means to access the Service without our express permission
Reverse engineer, decompile, or attempt to extract source code from the Service
Upload malicious code, viruses, or any harmful content
Harass, abuse, or harm other users or our staff
Impersonate any person or entity
Collect or store personal data about other users without their consent

5. Fishing regulations

Important: The Service provides environmental data, Journal, checklist, Trip Sharing, and Fishalong features for informational, personal record-keeping, and preparedness purposes only. You are solely responsible for:

Obtaining valid fishing licenses and permits as required by applicable federal, state, and local laws
Knowing and following all fishing regulations, including seasons, catch limits, size requirements, and gear restrictions
Respecting private property, access restrictions, and conservation areas
Practicing safe and ethical fishing methods

Thalweg Fishing is not a substitute for official fishing regulations. We do not guarantee that regulatory information displayed in the Service is accurate or current. Always verify regulations with official sources (e.g., state fish and wildlife agencies).

6. Data accuracy

The Service displays environmental data from third-party sources including USGS, NOAA, and Open-Meteo. While we strive to present accurate information:

No warranty of accuracy: We do not guarantee that water conditions, weather forecasts, source-reported tide data, or other environmental data are accurate, complete, or current
Data delays: There may be delays between real-world conditions and data displayed in the Service
Third-party sources: We are not responsible for errors, omissions, or outages in data from USGS, NOAA, or other data providers
Safety decisions: Do not rely solely on the Service for safety-critical decisions. Always use your own judgment and consult official sources
Trip Sharing is not an emergency service: It does not verify your safety or guarantee rescue, dispatch, or message delivery

Trip Sharing lets you set a planned return, share selected Trip details, send voluntary status updates, and notify selected contacts if the Trip is overdue. A check-in does not extend your planned return or confirm that you are safe. Extend the planned return or end the Trip when appropriate.

App and email notifications depend on the Trip and its changes reaching the service, notification settings, network availability, and delivery services. A change saved on your phone and waiting to sync is not confirmation that a contact has received it. If the service hasn’t received the update ending your trip, it may still send an overdue notification. Notifications already sent cannot be recalled.

Offline support applies to the phone apps. It does not provide offline operation of the web product or offline maps. An offline Trip cannot begin server-based sharing or overdue monitoring until it synchronizes. Permissions, battery settings, operating-system behavior, and signal can interrupt recording or delay location updates. A displayed location shows where someone was when it was recorded; it does not guarantee their current position.

Anyone with a Trip Sharing link can open the permitted view of that Trip without signing in, including someone it is forwarded to. Review the details and location scope before sharing. Pausing location sharing stops new location updates; it does not revoke the link or erase previously shared information. Ending a Trip stops new updates, but existing links remain readable until you revoke their shares. Revocation cannot recall information someone has already saved.

Make sure the people you select understand the messages and access they may receive. Maintain a separate communication and emergency plan. Trip Sharing and Fishalong do not contact emergency services or replace official emergency communications.

8. Your content and sharing choices

The Service allows you to create, upload, and store content such as Journal entries, catches, observations, photos, notes, checklists, and Trip details ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a limited license to:

Store and display your User Content to you within the Service
Create backups of your User Content for disaster recovery
Process your User Content to provide features you request, such as environmental context, personal statistics, Catch Cards, Trip Sharing, Fishalong, and Groups
Display or deliver selected information to the people you choose when you use sharing features
Show what you post or send in a group or a direct message to its members, including people who join a group later, until it is deleted as these Terms describe, even after you leave or are removed

This license does not permit Thalweg Fishing to use private fishing records for its own fishing research, reports, recommendations, or internal fishing intelligence, or combine them with other anglers’ records for those purposes. The restriction also applies to anonymized or aggregated records. Ordinary service operation, backups, synchronization, support, and security remain permitted under our Privacy Policy.

You control deliberate sharing. A Catch Card is an image, and its recipient does not receive access to your underlying Journal. Fishalong catches and observations you choose to share are visible to the outing’s members. Review all shared content for sensitive details and visible location clues. Recipients may keep or forward information, and deleting the original does not recall their copies.

You are solely responsible for your User Content. You represent that you have all necessary rights to upload your User Content and that it does not violate any third-party rights or applicable laws.

Groups and direct messages

Groups and direct messages are private and invite-only. Everything you post or send in a group or a direct message, including a group name you choose and your display name, is User Content. We do not tolerate objectionable content or abusive behavior there. You will not post or send content that:

Harasses, threatens, bullies, or abuses anyone
Is hateful or discriminatory, sexually explicit, or graphically violent, or promotes self-harm, terrorism, or violent extremism
Exploits or endangers minors, including child sexual abuse material or any sexual exploitation of a child
Shares another person’s private information, including their location, without their permission
Promotes illegal activity, including fishing in violation of regulations
Is spam, a scam, or malicious code, or impersonates someone
Infringes someone else’s intellectual property or other rights

You can report anything posted in a group or a direct message, or the person who posted it, and block a person in the Service. If you can’t report something in the Service, email support@thalwegfishing.com. We act on reports within 24 hours. We remove content that violates these Terms, and we may remove the person responsible from the groups concerned and suspend or terminate their account. Group owners and admins can also remove messages and members from their groups. We report child sexual abuse material to the National Center for Missing & Exploited Children.

Messages and photos you post in a group stay with that group after you leave or are removed, and its members, including people who join later, can still see them. You can edit or delete your own messages only while you are a member. When your account is deleted, the messages and photos you posted are removed from every group and direct message; copies members saved to their devices are not recalled. If a group’s owner deletes the group, everything in it, including your messages and photos, is removed after seven days.

9. Intellectual property

The Service and its original content (excluding User Content), features, and functionality are owned by Thalweg Fishing LLC and are protected by copyright, trademark, and other intellectual property laws.

The Thalweg Fishing name, logo, and related marks are trademarks of Thalweg Fishing LLC. You may not use our trademarks without our prior written consent.

10. Service availability

We strive to maintain high availability, but we do not guarantee uninterrupted access to the Service. The Service may be:

Temporarily unavailable due to maintenance or updates
Affected by outages in third-party services (including USGS and NOAA)
Subject to rate limiting or access restrictions to prevent abuse

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable for any modification, suspension, or discontinuation.

11. Outside services

The Service may contain links to third-party websites or services that are not owned or controlled by Thalweg Fishing. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY ENVIRONMENTAL DATA, WEATHER FORECASTS, TIDE PREDICTIONS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THALWEG FISHING LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, or use
Personal injury or property damage
Costs of procurement of substitute services
Any damages arising from reliance on environmental data or forecasts

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Thalweg Fishing LLC, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your User Content
Your violation of any applicable laws or regulations

15. Account termination

You may terminate your account at any time by using the account deletion feature in the Service. Contact support if you need help.

Contact support

A deletion request has a seven-day grace period during which it can be cancelled. Processing begins after that period and can take additional time. Once processing starts, it cannot be cancelled. Our Privacy Policy explains account deletion in more detail.

We may suspend or terminate your account and access to the Service immediately, without prior notice, if:

You breach these Terms
We reasonably believe your account is being used for illegal activity
We are required to do so by law
We discontinue the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that should survive termination shall survive.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

When we change the terms for groups and direct messages, we will ask you to accept them in the Service before you post, invite someone, or send a message again.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

17. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action or representative action.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified and interpreted to accomplish the objectives of the original provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

19. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Thalweg Fishing LLC regarding the Service and supersede all prior agreements and understandings.

20. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Thalweg Fishing LLC.
