Welcome to Thalweg. These Terms of Service ("Terms") govern your use of the Thalweg fishing intelligence platform at thalweg.app (the "Service") operated by Thalweg ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You will not:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Service for any illegal fishing activities or to facilitate violation of fishing regulations
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated scripts, bots, or other means to access the Service without our express permission
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Upload malicious code, viruses, or any harmful content
  • Harass, abuse, or harm other users or our staff
  • Impersonate any person or entity
  • Collect or store personal data about other users without their consent

4. Fishing Regulations Compliance

Important: The Service provides environmental data and catch logging features for informational and personal record-keeping purposes only. You are solely responsible for:

  • Obtaining valid fishing licenses and permits as required by applicable federal, state, and local laws
  • Knowing and following all fishing regulations, including seasons, catch limits, size requirements, and gear restrictions
  • Respecting private property, access restrictions, and conservation areas
  • Practicing safe and ethical fishing methods

Thalweg is not a substitute for official fishing regulations. We do not guarantee that regulatory information displayed in the Service is accurate or current. Always verify regulations with official sources (e.g., state fish and wildlife agencies).

5. Data Accuracy Disclaimer

The Service displays environmental data from third-party sources including USGS, NOAA, and Open-Meteo. While we strive to present accurate information:

  • No warranty of accuracy: We do not guarantee that water conditions, weather forecasts, tide predictions, or other environmental data are accurate, complete, or current
  • Data delays: There may be delays between real-world conditions and data displayed in the Service
  • Third-party sources: We are not responsible for errors, omissions, or outages in data from USGS, NOAA, or other data providers
  • Safety decisions: Do not rely solely on the Service for safety-critical decisions. Always use your own judgment and consult official sources

6. User Content

The Service allows you to create, upload, and store content such as catch logs, photos, waypoints, and notes ("User Content"). You retain ownership of your User Content. By uploading User Content, you grant us a limited license to:

  • Store and display your User Content to you within the Service
  • Create backups of your User Content for disaster recovery
  • Process your User Content to provide Service features (e.g., generating environmental snapshots)

You are solely responsible for your User Content. You represent that you have all necessary rights to upload your User Content and that it does not violate any third-party rights or applicable laws.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Thalweg and are protected by copyright, trademark, and other intellectual property laws.

The Thalweg name, logo, and related marks are trademarks of Thalweg. You may not use our trademarks without our prior written consent.

8. Service Availability

We strive to maintain high availability, but we do not guarantee uninterrupted access to the Service. The Service may be:

  • Temporarily unavailable due to maintenance or updates
  • Affected by outages in third-party services (USGS, NOAA, cloud providers)
  • Subject to rate limiting or access restrictions to prevent abuse

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable for any modification, suspension, or discontinuation.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Thalweg. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY ENVIRONMENTAL DATA, WEATHER FORECASTS, TIDE PREDICTIONS, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THALWEG, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Personal injury or property damage
  • Costs of procurement of substitute services
  • Any damages arising from reliance on environmental data or forecasts

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Thalweg, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Your violation of any applicable laws or regulations

13. Account Termination

You may terminate your account at any time by using the account deletion feature in the Service or by contacting us.

We may suspend or terminate your account and access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • We reasonably believe your account is being used for illegal activity
  • We are required to do so by law
  • We discontinue the Service

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that should survive termination shall survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action or representative action.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified and interpreted to accomplish the objectives of the original provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Thalweg regarding the Service and supersede all prior agreements and understandings.

18. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by Thalweg.
